Resumen
En el documento se analizaron los aspectos generales del camino recorrido por la Corte Constitucional para dar a algunos de sus fallos, rango de Ley. Se parte de una breve descripción del caso del derecho anglosajón Marbury vs. Madison, para luego cotejar la interpretación que sobre el término ‘leyes’ tiene la Corte Interamericana de Derechos Humanos, con la aprehendida por la Corte Constitucional colombiana. A través del análisis documental de distintas normas y sentencias se detallaron los argumentos dados por la Corte Constitucional para justificar un cambio de valor de su jurisprudencia. El resultado da cuenta de la pretensión de incremento de poder político del organismo de cierre judicial en materia constitucional, que conlleva a un desbalance de la clásica división tripartita del poder público.
Abstract
Analysis of the consolidati on of the Constitutional Precedent as a primary source of law
The general aspects of the path followed by the Constitutional Court in order to determine certain judgments were analyzed in the document, law ranking. It starts with a brief description of the Anglo-Saxon case Marbury vs. Madison, then followed by the comparison of the interpretation of the term “laws” as held by the Inter- American Court of Human Rights, as apprehended by the Colombian Constitutional Court. The arguments given by the Constitutional Court in order to justify a change in the value of its jurisprudence were detailed through the documental analysis of different norms and sentences. The result accounts for the claim to increase the political power of the judicial closure organism in constitutional matters, which entails to an imbalance of the classical tri party division of the public power.
