Resumen
Conocer la responsabilidad legal del equipo quirúrgico protege la integridad de los instrumentadores quirúrgicos en su campo laboral, lo que le permite asumir qué es lo correcto, qué se debe hacer y conocer cómo se debe actuar cuando se presenta una acción legal. En todo acto quirúrgico se hacen presentes varios profesionales que conforman el equipo quirúrgico, todos con un mismo objetivo. En todos los procedimientos quirúrgicos es el cirujano quien carga con la mayor y más representativa responsabilidad; aunque en cirugía pueden llegar 33
a intervenir varios profesionales, esto no quiere decir que frente a un evento adverso, lleguen a ser culpados todos los integrantes del equipo quirúrgico, ya que según la ley colombiana, solo están obligados a responder las personas o la persona que condujo al error. En cualquier caso legal, el personal que hace parte del equipo quirúrgico responde ante la ley de manera individual, toda vez, que para ello, es tenida en cuenta la autonomía, el grado de conocimiento, la pericia y la experiencia profesional. En la actualidad son pocos los instrumentadores quirúrgicos que están informados sobre la responsabilidad legal en el contexto de su ejercicio profesional, ante un error que llegue a afectar el resultado de la intervención poniendo en riesgo la integridad del paciente. Se debe entender que no todo error quirúrgico se puede catalogar como negligencia del equipo o de alguno de sus integrantes.
Abstract
To know the legal responsibility of the surgical unit protects the integrity of the Assistant surgical in his labor field, which allows him to have that it is the correct thing, which it is necessary to do and to know how it is necessary to to act when one presents a legal action. In any surgical act there become present several professionals who shape the surgical unit, all with the same aim. In all the surgical procedures he is the surgeon who loads with the major one and more representative responsibility; though in surgery several professionals can manage to intervene, this does not want to say that opposite to an adverse event, all the members of the surgical unit should manage to be blamed, since according to the Colombian law, only the persons or the person are forced to answer that led to the error, In any legal case the staff that makes the surgical team before the law responds individually, since, that is taken into account the autonomy, the degree of knowledge, expertise and professional experience. At present there are few surgical makers that are informed about the legal liability in the context of their professional practice, before an error that will affect the outcome of the intervention by putting at risk the integrity of the patient. It should be understood that not all surgical error can be categorized as negligence of the computer or any of its members.
