@article{Saavedra Ramírez_Lozano Guio_2015, title={Vinculatoriedad del precedente y jurisprudencia como doctrina probable frente a la doctrina del derecho viviente (Diritto vivente)}, volume={8}, url={https://revia.areandina.edu.co/index.php/Pp/article/view/389}, abstractNote={<p>Colombia, influenciada desde sus orígenes por el sistema francés, sistema por demás rígido frente a la aplicación de la Ley como única fuente formal, indujo en nuestro país una interpretación igualmente rígida sobre las fuentes en la aplicación del derecho, de esta forma en nuestro ordenamiento la única fuente formal era la ley, subsidiariamente la costumbre, la jurisprudencia, los principios generales del derecho y la doctrina cumplían como criterios auxiliares de interpretación. Sin embargo este rigorismo ha cambiado en las últimas décadas producto de la propia jurisprudencia emitida por las Cortes de Cierre y en especial por la Corte Constitucional, quien ha interpretado el artículo 230 de la Constitución Política de forma flexible permitiendo que la jurisprudencia emitida por las referidas Cortes, se pueda convertir en Doctrina Probable y a su vez generar vinculatoriedad frente a los jueces de menor jerarquía y a los pronunciamientos emanados por las Cortes de Cierre. Es claro que aun cuando hoy se habla válidamente de Teorías de la Inaplicación del precedente, indirectamente la vinculatoriedad de las sentencias de las Cortes de Cierre se convierte en un elemento de la práctica judicial, esto apoyado en nuevas doctrinas como El Derecho Viviente, que conlleva a que la valoración de la interpretación de la jurisprudencia equivalga a la armonización en la interpretación del mismo, y a no poner en riesgo principios como la igualdad. Este artículo pretende recoger los principales postulados sobre el sistema de precedentes, la doctrina probable y el derecho viviente, con el fin de analizar cuál es el efecto vinculante de las sentencias de los máximos tribunales en nuestro país.</p><p><strong>Palabras clave:</strong> Doctrina probable, jurisprudencia, derecho viviente, hermenéutica jurídica, fuerza vinculante</p><p><strong>Abstract</strong></p><p>Colombia, influenced by the French system since its origin, a rigid system against the law enforcement as the only formal source, created in our country an equally rigid interpretation about sources in law enforcement. In this way, in our system the only formal alternative source was the law and daily, case law, principles of law and doctrine fulfill as auxiliary criteria for interpretation. However, this strictness has changed in the last decades as a product of jurisprudence issued by Courts of Closing and especially by the Constitutional Court, which has interpreted the Article 230 of the Constitution as flexibly way allowing the jurisprudence issued for the courts mentioned can be transformed in Probable Doctrine and to generate entailment between lower-ranking judges and the pronouncements issued by the Courts of Closing. It is clear that even though today it is talk about validity of Nonapplication Theories of precedent, indirectly the entailment between judgments of Courts of Closing becomes an element of judicial practice,<br />this is supported in new doctrines as Living Right, that entails to the assessment of the interpretation of jurisprudence being equal to the harmonization in the interpretation thereof, and not threatening principles such as equality. This article aims to include the main tenets of the precedents system, the probable doctrine and the living right, in order to analyze which is the binding effect of the decisions of the highest courts in our country.</p><p><strong>Keywords:</strong> Probable doctrine, jurisprudence, right living, legal hermeneutics, binding force</p><p> </p><p> </p&gt;}, number={2}, journal={Teoría y praxis investigativa}, author={Saavedra Ramírez, Laura Cristina and Lozano Guio, Luis Carlos}, year={2015}, month={jul.}, pages={18 - 30} }
